In accordance with the Town Charter, the Town Clerk serves as the Clerk of the Probate Court. The Town Clerk also serves as Acting Judge in the absence or inability of the Probate Judge or Town Solicitor to serve in that capacity. All petitions filed in association with the administration of the estate of a resident or property owner in the Town of South Kingstown are filed in this office and scheduled for hearing. The Probate Court is normally held the third Thursday of each month at 2:00 PM at the Town Hall in the Town Council Chambers (see link below for 2010 Court Calendar). All petitions that do not require advertising or those that are on waiver should be submitted to the Town Clerk by noon on the Friday preceding the Court session. The required fees must accompany all petitions.
Probate Forms may be obtained by clicking the link here.
Please note that the Probate Clerk will do everything possible to expedite the petitions but can in no way offer any legal advice. We strongly recommend that you seek legal advice from your attorney.
