Cesspools are considered to be a substandard and inadequate means of onsite wastewater treatment and must be replaced with an onsite wastewater system which conforms to current state and local standards within twelve (12) months after the sale of a property or within five (5) years of the date of the First Maintenance (baseline) Inspection, whichever comes first.
If the ISDS inspection report identifies a failed cesspool or a cesspool with evidence of structural damage, overflow or standing water above the invert, then the property owner shall have eighteen (18) months from the date of Notice of Violation to design and replace the failed cesspool with a new ISDS as approved by the appropriate regulatory authority. In addition, any cesspool that requires two (2) or more pumpings within a twelve (12) month period shall have eighteen (18) months from the date of the Notice of Violation to design and replace the cesspool with a new ISDS as approved by the appropriate state regulatory authority.
