The South Kingstown Police Department will at times release information to the public pursuant to RI General Laws §11-37.1-1 et seq., also known as the Sexual Offender Registration and Community Notification Act. RIGL §11-37.1-12 of the act authorizes law enforcement agencies to inform the public of a sex offender's release from prison when the Sex Offender Board of Review determines that the release of information will enhance public safety and protection. The assigned risk level of an offender is indicative of his/her potential for re-offense.
The individuals appearing on these notifications have been convicted of certain crimes that require registration with the law enforcement agency that has jurisdiction over their residences. The police have no legal authority to direct where an offender may or may not reside, work, or go to school. An offender is constitutionally free to live wherever he/she chooses, unless court ordered restriction exists, the offenders have served the sentences imposed by the courts and will be living in the community. The notifications are not intended to increase fear in the community, and it is the belief of the South Kingstown Police that an informed public is a safe public. It was not until passage of the Sexual Offender Registration and Community Notification Act that law enforcement even knew where these individuals were residing. Abuse of this information, and its use to threaten, intimidate, or harass registered offenders will not be tolerated and may be a crime. Such abuse could also have a negative impact on law enforcement's ability to keep the public informed.
